Were you hit by an uninsured or underinsured driver?
Under Texas law, drivers are required to be able to cover any damages they cause others in car accidents, including damages for injuries. The most common way of complying with this law is to obtain liability insurance. When individuals buy this type of auto insurance, they must meet the following minimum liability coverage limits:
- $30,000 per person who is injured (up to $60,000 per accident)
- $25,000 for property damage (per accident)
The unfortunate thing is that there are many drivers on the road who either uninsured, underinsured and/or unable to pay for the damages out of their own pockets. The Texas Department of Motor Vehicles estimates that 20% of drivers in the state of Texas do not have auto insurance.
If the at-fault driver in your accident is uninsured or underinsured, you may be left panicking about how you will get compensated for your losses. Fortunately, if you have uninsured/underinsured motorist (UM/UIM) coverage, you can file a claim through your own insurance company. You can also seek a settlement through this coverage if you are the victim of a hit-and-run accident. Our Katy car accident lawyers from Adams Law Firm are here to walk you through each step of the claims process!
What does UM/UIM insurance cover?
According to the Texas Department of Insurance, there are two different types of UM/UIM coverage, which include the following:
- Bodily injury UM/UIM: covers medical expenses, lost income, permanent or partial disability, disfigurement, and pain and suffering
- Property damage UM/UIM: covers expenses for vehicle repairs, car rentals and damage caused to property inside the vehicle (victim must pay $250 deductible)
The good thing about UM/UIM insurance is that in addition to covering the insured driver, it also covers passengers of insured’s vehicle, the insured’s family members and others who are driving the vehicle with the insured’s consent.
Our attorneys can help you file a claim under your UM/UIM insurance coverage and also take advantage of any other possible avenues for securing fair compensation.
